Terms Governing the Use of Trademarks on the SOUTH AFRICAN SOCIAL MEDIA AWARDS

1. Introduction

Welcome to the official website of the SOUTH AFRICAN SOCIAL MEDIA AWARDS (“SASMA”, “we”, “us”, or “our”). The following Terms and Conditions (“Terms”) govern your use of the SOUTH AFRICAN SOCIAL MEDIA AWARDS trademarks and all related trademarks, logos, and service marks owned or licensed by SASMA (collectively referred to as the “SASMA Marks”) in relation to this website and its content. 2. Definition of SASMA Marks

For the purposes of these Terms, “SASMA Marks” refers to all trademarks, service marks, logos, insignias, slogans, taglines, event titles, or other distinctive brand features associated with the SOUTH AFRICAN SOCIAL MEDIA AWARDS, whether registered or unregistered, in South Africa or any other jurisdiction. 3. Ownership and Protection of the SASMA Marks

The SASMA Marks are the exclusive property of the SOUTH AFRICAN SOCIAL MEDIA AWARDS (SASMA) NPC and are protected under South African trademark law, including the Trade Marks Act 194 of 1993, as well as applicable international treaties. Use of the SASMA Marks without express prior written permission from SASMA is strictly prohibited.

You acknowledge that nothing in these Terms, nor your use of this website, grants you any right, title, or interest in or to the SASMA Marks except as expressly permitted herein. Any goodwill derived from use of the SASMA Marks will inure solely to the benefit of SASMA.

4. Permitted Use

You may not use the SASMA Marks or any confusingly similar marks in any manner unless you have received explicit, written authorization from SASMA. Limited use may be permitted in the following circumstances:

  • For media reporting and news coverage, provided such use is fair, accurate, non-derogatory, and includes appropriate attribution.

5. Prohibited Uses

You may not, under any circumstances:

  • Use the SASMA Marks in any way that suggests or implies partnership, endorsement, or affiliation with SASMA unless such relationship exists and is confirmed in writing.
  • Modify, distort, or alter the SASMA Marks in any way, including changes to color, proportion, or font.
  • Register or use domain names, social media accounts, or business names incorporating the SASMA Marks or any confusingly similar marks.
  • Use the SASMA Marks in association with any unlawful, defamatory, obscene, or otherwise objectionable material.
  • Sell, license, or otherwise commercialize the SASMA Marks or any derivative works without express permission.

6. Application for Permission

To request permission for use of any SASMA Mark, please contact SASMA directly at the designated email address provided on the website. Your request should include:

  • The specific SASMA Mark(s) you wish to use
  • The context in which the mark will be used (e.g., website, print, social media, merchandise)

  • Sample materials showing how the mark will appear

SASMA reserves the right to deny any request at its sole discretion, for any reason.

7. Misuse and Enforcement

SASMA actively monitors the use of its trademarks and will take all appropriate legal action against unauthorized use, including seeking damages, injunctive relief, and/or the recovery of costs and legal fees. Misuse of the SASMA Marks may also result in suspension or termination of your access to the website or related services.

8. Reporting Violations

If you become aware of any improper, unauthorized, or potentially infringing use of the SASMA Marks, please report it immediately to SASMA via the contact information provided on the website. SASMA will investigate all reported violations and take appropriate action where necessary.

If any provision of these Terms is found to be invalid or unenforceable, such provision shall be severed, and the remainder of the Terms shall remain in full force and effect.
