SASMA COMPETITIONS STANDARD TERMS & CONDITIONS

Legal Requirements and Participant Guidelines

These standard terms and conditions (“Terms & Conditions”) apply to all the Soth African Social Media Awards Competitions (“Competitions”) conducted in the Republic of South Africa. By entering or participating in this Competitions, all entrants agree to be bound by these Terms & Conditions. The Competitions are subject to all applicable South African laws, including but not limited to the Consumer Protection Act No. 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act No. 25 of 2002 (“ECTA”), and regulations issued under these acts.

1. Promoter Details

The Competitions are promoted SASMA specified in the official Competitions announcement (“Promoter”). For the purposes of these Terms & Conditions, “Promoter” includes its representatives, agents, and affiliates associated with the Competitions.

2. Eligibility

  • The Competitions are open to legal residents of South Africa aged 18 years or over as of the date of entry, unless otherwise specified in the official Competitions announcement.
  • Employees, directors, officers, and agents of the Promoter or any associated companies or agencies, and their immediate family members, are not eligible to enter.
  • Entrants may be required to provide proof of age and identity upon request.

3. Competitions Period

  • The Competitions period (“Entry Period”) will be clearly stated in the official announcement on the Promoter’s social media pages or website.
  • Entries received outside the Entry Period will not be considered.

4. How to Enter

  • Participation is free and does not require any purchase unless explicitly stated.
  • To enter, participants must follow the entry instructions specified by the Promoter. This may include following or liking social media pages, commenting on posts, sharing content, or submitting user-generated content (“UGC”) such as images, videos, or captions.
  • Only entries received via the official Competitions channels will be eligible.
  • Multiple entries may be permitted if specified, but only one prize per person is allowed.
  • Entries that do not comply with the entry requirements or breach community guidelines will be disqualified.

5. Prize Details

  • The nature and value of prizes will be described in the official Competitions announcement.
  • Prizes are not transferable, exchangeable, or redeemable for cash unless otherwise specified.
  • If a prize becomes unavailable, the Promoter reserves the right to substitute it with another prize of equal or greater value, subject to any applicable law.
  • Winners are responsible for any taxes or costs not expressly included in the prize.

6. Selection of Winners

  • Winners will be selected in accordance with the method described in the official Competitions announcement. This may involve random draw, voting, or judging by a panel.
  • All decisions regarding winner selection are final and binding, and no correspondence will be entered into.
  • If a winner is disqualified or cannot be contacted within 5 business days, the prize may be forfeited and awarded to another eligible participant.

7. Notification and Announcement of Winners

  • Winners will be notified via direct message, email, or telephone as provided in their entry, and may also be announced on the Promoter’s official social media or website.
  • Winners must respond with required verification documents or acceptance within the stipulated time frame.

8. Delivery of Prizes

  • Arrangements for delivery or collection of prizes will be communicated to winners after confirmation of eligibility.
  • The Promoter will not be liable for any loss or damage to prizes after delivery or collection.

9. Disqualification and Disputes

  • The Promoter reserves the right to disqualify any entrant suspected of fraud, manipulation, or breach of these Terms & Conditions or community standards.
  • The Promoter’s decision in all matters relating to the Competitions shall be final.
  • Any disputes arising out of or in connection with the Competitions will be resolved in accordance with South African law and subject to the exclusive jurisdiction of South African courts.

10. Use of Personal Information

  • By entering, participants consent to the collection and processing of their personal information for the purposes of administering the Competitions, announcing winners, and awarding prizes.
  • The Promoter will comply with the Protection of Personal Information Act No. 4 of 2013 (“POPIA”) and its privacy policy regarding the storage, use, and sharing of participant data.
  • Entrants may have their names and images published on the Promoter’s channels for publicity purposes, subject to their consent where required by law.

11. User-Generated Content

  • By submitting UGC, participants grant the Promoter a non-exclusive, royalty-free, worldwide right to use, reproduce, modify, publish, and display the content in relation to the Competitions and for promotional purposes.
  • Participants warrant that their UGC is original, does not infringe intellectual property or privacy rights, and does not contain unlawful, defamatory, or offensive material.
  • The Promoter reserves the right to remove or disqualify any UGC deemed inappropriate or in violation of these Terms & Conditions.

12. Limitation of Liability

  • To the maximum extent permitted by law, the Promoter is not responsible for any loss, damage, claim, or expense arising from participation in the Competitions or acceptance and use of prizes.
  • The Competitions are not sponsored, endorsed, administered by, or associated with any social media platform. Participants release such platforms from any liability related to the Competitions.
  • The Promoter does not guarantee uninterrupted or error-free access to Competitions pages and is not liable for technical failures or issues beyond its control.

13. General Terms

  • The Promoter reserves the right to suspend, cancel, or amend the Competitions or these Terms & Conditions at any time, with or without prior notice and without liability.
  • Any changes to the Terms & Conditions or Competitions details will be communicated via the official Competitions channels.
  • If any provision of these Terms & Conditions is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

14. Governing Law

  • These Terms & Conditions are governed by the laws of the Republic of South Africa.
  • Any legal proceedings related to the Competitions must be instituted in a South African court with appropriate jurisdiction.
